OHS in Australia

OHS in Australia applies in any industry where people are employed to work. Employers have a duty of care to provide workplaces that are safe and without risk to health.  Employees have a duty while at work to take care of their own safety and the safety of others and co-operate with their employer.

Model work health and safety (WHS) laws

Safe Work Australia is currently developing model work health and safety laws as part of an initiative of the Council of Australian Governments. This initiative demonstrates a commitment to improving the work health and safety of all Australian workers and enhancing productivity.

The Commonwealth and each state and territory government have agreed to harmonise their work health and safety laws (including Regulations and Codes of Practice) so that work health and safety laws are similar in each jurisdiction.

The Model Work Heath and Safety Act (draft) endorsed by Workplace Relations Ministers Council is now available.

Public comment

The public comment period for the draft model Work Health and Safety Regulations and model Codes of Practice closed on Monday 4 April 2011 and the MPMSAA Model WHS Regulations and codes of Practice Public Comment Response submission is now available.

Our submission contains the views of; members expressed to the MPMSAA through day-to-day contact; The Australian Chamber of Commerce and Industry (ACCI) Occupational Health and Safety Working Party Meetings; and discussions with our key stakeholders.

The state of play  ...........

What happens next ...........

The Commonwealth and each state and territory will be required to enact laws that reflect the model work health and safety laws by the end of December 2011.   It is expected that all laws will commence on 1 January 2012.

After the enacting of the new legislation.   The MPMSAA will commence the update of our WHS Management Plan Template and disseminate it to those who already have a 'registered plan' and are 'financial' for implementation for a small fee.

The plan and a training course is available to both members and non-members, click -> WHS Plan Template

January 2012 - Commencement of the Model Work Health and Safety Act and model WHS Regulations.

Model Codes of Practice will be developed and implemented at the same time as the model WHS Regulations. However, development and implementation of further model Codes of Practice will continue beyond December 2011.

Safe Work Australia has developed transitional principles that set out how arrangements under existing work health and safety (WHS) legislation are intended to transition to the new system. This will ensure a co-ordinated approach is taken to implementation following commencement of the model WHS Act, and that so far as possible all jurisdictions adopt harmonised transitional arrangements.  see Transitional Principles

Establish a WHS system today

The development and implementation of an WHS system based on the principles of risk management and consultation is recommended by MPMSAA to it's members to ensure the health and safety of all employees, independent contractors and their employees, the general public and protection of facilities, plant, equipment and the environment.

Another three reasons to establish an WHS system are:

  • Government fines and penalties
  • Lawsuits and negligence claims
  • Increased workers compensation premiums

The MPMSAA OHS Officer is available to assist members with WHS compliance documents and information on safe work practices and can also help members create, manage and maintain an effective WHS System to ensure a safe work environment.
